These Terms of Service govern your use of Nexus services and website. By accessing or using Nexus, you agree to be bound by these terms and our Privacy Policy. If you don't agree with these terms, please don't use our services.

Important: Nexus is currently in development. These terms cover our current development phase and will be updated before product launch.

1. Service Description

Current Development Phase

During development, Nexus provides:

  • Information about our upcoming personal-first financial operating system
  • Early access registration and communication
  • User research and feedback opportunities
  • Educational content about couple-focused financial management

Future Product Services

When launched, Nexus will provide:

  • Personal-first budgeting and financial management tools
  • Collaborative financial planning features for couples
  • Automated savings and resilience building systems
  • Constitutional framework for financial partnership governance
  • Integration with banking and financial service providers

2. Eligibility & Account Requirements

To use Nexus services, you must:

  • Be at least 18 years of age
  • Have legal capacity to enter into agreements
  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Use services for lawful purposes only

Partnership Accounts

Nexus is designed for couples and partnerships. When creating joint features:

  • Both partners must individually consent to shared features
  • Each partner maintains independent account rights
  • Joint decisions require dual authorization
  • Either partner can initiate account separation protocols

3. The Nexus Constitutional Framework

These terms are designed to align with Nexus's constitutional principles of clarity, consent, and individual sovereignty within partnerships.

  • Personal Sovereignty: Your personal account data remains private and under your individual control
  • Dual Consent: Shared features require explicit agreement from both partners
  • Clarity First: All terms, features, and charges will be clearly explained
  • Anti-Coercion: Features are designed to prevent financial abuse and coercion
  • Right to Exit: You maintain the right to discontinue services and export your data

4. Prohibited Uses

You may not use Nexus services to:

  • Engage in any unlawful, fraudulent, or deceptive activities
  • Violate any applicable laws, regulations, or third-party rights
  • Harm, harass, or intimidate other users (including your partner)
  • Use services for money laundering, terrorism financing, or other financial crimes
  • Circumvent security measures or anti-coercion protections
  • Interfere with the proper functioning of the platform
  • Use automated systems to access services without authorization
  • Share account credentials or allow unauthorized access

5. Financial Services Compliance

When Nexus launches financial services:

Regulatory Compliance

  • Services will be provided under appropriate Australian financial licenses
  • We will comply with AML/CTF, privacy, and consumer protection laws
  • Identity verification and due diligence will be required
  • Transaction monitoring and reporting will be implemented as required

6. Anti-Coercion & Safety Protections

Nexus includes specific protections against financial abuse:

  • Time-Delayed Changes: Cooling-off periods for significant modifications

If you experience financial coercion:

7. Data Ownership & Portability

Your relationship with your data:

  • You Own Your Data: Your financial and personal data belongs to you
  • Export Rights: You can export your data in standard formats
  • Deletion Rights: You can request data deletion (subject to legal requirements)
  • Individual Control: Each partner controls their own data independently
  • No Data Hostage: We will never prevent you from accessing or exporting your data

8. Service Availability & Changes

Service terms:

  • Services are provided "as is" during development phase
  • We may modify, suspend, or discontinue features with notice
  • Planned maintenance and updates will be communicated in advance
  • We strive for high availability but cannot guarantee 100% uptime
  • Beta and testing features may have reduced availability

9. Pricing & Payment Terms

Development Phase

Current development phase services are provided free of charge.

Future Pricing

  • Pricing will be clearly communicated before product launch
  • Early access users will receive preferential pricing
  • No hidden fees or surprise charges
  • Transparent fee structure aligned with constitutional principles
  • Option to cancel or downgrade services

10. Limitation of Liability

Development Phase: These limitations apply to our current development services and will be updated for full financial services.

To the maximum extent permitted by law:

  • Services are provided on an "as is" and "as available" basis
  • We disclaim warranties regarding accuracy, completeness, or availability
  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to amounts paid by you in the past 12 months
  • These limitations do not apply to gross negligence or willful misconduct

11. Account Termination

Your Right to Terminate

You may terminate your account at any time by:

  • Using account closure features within the platform
  • Contacting customer support
  • Following the Staged Severance Protocol for partnership accounts

Our Right to Terminate

We may suspend or terminate accounts for:

  • Violation of these terms
  • Suspected fraudulent or illegal activity
  • Failure to comply with identity verification requirements
  • Extended inactivity (with advance notice)

12. Dispute Resolution

For disputes:

  • Mediation: We encourage mediation for complex disputes
  • Australian Law: Terms are governed by Australian law
  • Jurisdiction: Courts of Australia have exclusive jurisdiction
